General Terms and Conditions
§ 1 Scope of Application
1.1 The following provisions apply to all contracts between Euziel International GmbH, Grünenplatzstr. 16-18, D-42899 Remscheid, and the customer concluded via the Manomano Internet platform.
1.2 Agreements made with the customer in individual cases (including collateral agreements, supplements, and amendments) shall, in any case, take precedent over these terms and conditions.
1.3 These conditions apply to natural or legal persons or partnerships with legal capacity who, when concluding the contract, act in the exercise of their commercial or independent professional activity (Entrepreneur, § 14 German Civil Code) and natural persons with whom a business relationship is entered into without any commercial or self-employed professional activity being attributable to them (Consumer, § 13 German Civil Code). Both entrepreneurs and consumers can be customers.

The product descriptions of the seller presented at Manomano do not represent binding offers on the part of the seller but serve for the submission of a binding offer by the customer.
§4 Delivery& Transfer of Risk
As a rule, purchased goods are delivered to the delivery address specified by the customer in connection with the order, unless otherwise agreed. The delivery address specified in the seller's order processing is decisive for the processing of the transaction.

§ 6 Warranty
We guarantee that the purchased goods are free of defects within the statutory warranty periods. The period begins with the delivery of the item. There is no warranty for damages caused by improper use or handling of the goods by the customer.
For all defects occurring during the statutory warranty period, you may choose between a supplementary performance by repair or replacement if and to the extent that the statutory provisions on rights in the event of defects apply. However, we are entitled to refuse the type of supplementary performance chosen if it is only possible with disproportionate costs, and another type of supplementary performance is reasonable for the customer. If the subsequent performance fails - provided that the legal requirements are met - you are entitled to further claims for reduction of the price or cancellation of the contract (rescission) as well as compensation for damages, including reimbursement of wasted expenses. If the customer is an entrepreneur, the warranty claims shall become statute-barred after one year in deviation from § 438 Para. 1 No. 3 BGB (German Civil Code).
In the case of companies, we initially provide a warranty for defects in the goods either by repair or replacement, at our discretion.
§ 7 Applicable Law and Place of Jurisdiction
7.1 The legal relationship between the customer and Euziel International GmbH shall be governed by German law to the exclusion of the UN Sales Convention if the customer has his usual place of residence in Germany. If the customer does not have his habitual residence in Germany, the mandatory consumer protection regulations of the legal system of the country in which the customer has his habitual residence remain unaffected by this choice of law.
7.2 The place of jurisdiction for any merchant, legal entity under public law, or a special fund under public law is Remscheid.

2. Consequences of Cancellation
If you cancel this contract, Manomano will refund all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the date on which we received the notice of your cancellation of this contract.
Manomano will use the same means of payment for repayment as you used for the original transaction unless expressly agreed otherwise; in no case will you be charged any fees for this repayment.
We may refuse to refund until we have received the returned goods or until you can prove that you have returned the goods, whichever occurs first.
You must return the goods to Euziel International GmbH, Hall 16, Grünenplatzstr. 16-18, 42899 Remscheid, Germany without delay, in any case, within fourteen days of the day on which you notify us of the cancellation of this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day deadline.
You must bear the direct costs of returning the goods if the delivered goods correspond to those ordered. In the case of goods that cannot be sent by parcel post, the direct costs of the return shipment are estimated at a maximum of approximately 70 EUR.
You only need to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking quality, properties, and functions of the goods.
The right of cancellation does not apply to consumers who do not belong to any member state of the European Union at the time of conclusion of the contract and whose sole place of residence and delivery address at the time of conclusion of the contract is outside the European Union.
